GENERAL TERMS AND CONDITIONS FOR THE USE OF VEHICLES OF DPTU GO CAR RENTAL LLC Strumica
1. DEFINITIONS:
"Less or / Lessor" – A legal entity that owns vehicles and rents them out to users for a specified period under agreed conditions;
"Lessee / User"– A natural or legal person who rents a vehicle from the Lessor, with the obligation to pay the agreed rental fee and all expenses arising from the rental;
"DPTU GO CAR RENTAL LLC Strumica" – The owner of the vehicle subject to the car rental agreement;
"Driver" – A person who physically operates the rented vehicle.
2. GENERAL PROVISIONS:
The Lessor provides the User with temporary use of a passenger motor vehicle owned by them, in proper technical condition, registered in accordance with legal regulations, and with all documents necessary for operation.
The vehicle is the inalienable property of DPTU GO CAR RENTAL LLC Strumica. The User has no other rights except those granted by the car rental agreement.
The driver must be at least 21 years old, possess a valid ID and driver’s license, and have a minimum of 2 (two) years of driving experience.
If the vehicle will also be operated by another person, they must be added to the rental agreement as an additional driver.
The User must inform the Lessor in advance about the countries they plan to travel to, which must be listed in the rental agreement.
The Lessor must comply with all traffic regulations and legal requirements in those countries. The Lessor bears full responsibility for any border, traffic, or administrative issues arising from driving the vehicle outside the Republic of North Macedonia.
All drivers must hold a valid driver's license and be at least 21 years old with 2 years of driving experience.
The User agrees that only the individuals listed as additional drivers in the rental agreement may operate the vehicle, provided they are approved by the Lessor and listed with valid details and a valid driver’s license. The User expressly assumes full responsibility for the actions and omissions of all additional drivers as if they were their own.
All traffic violations, fines, damages, administrative fees, lump sums, court proceedings, attorney fees, or any financial obligations resulting from operation by additional drivers are entirely borne by the User, who agrees to pay them immediately upon notice by the Lessor or a competent authority.
In the event of damage, accident, or theft caused by an additional driver, the User remains fully responsible for all direct and indirect consequences.
3. RENTAL FEE AND PAYMENT:
The User must pay the Lessor in advance for the total rental period via electronic payment using a payment card.
Upon the end of the rental period, the rental charges are calculated based on the applicable price list at the time of contract signing, including data in the contract, additional costs, and any special conditions. The User must settle the final invoice when returning the vehicle.
4. DEPOSIT:
On the day of signing the agreement, the User must pay a deposit of €400 (or MKD 24,640) for SKODA OCTAVIA or €300 (or MKD 18,480) for SKODA KAMIQ, as security against possible damages or traffic fines.
The deposit will be fully refunded within 7 days after the end of the rental period, provided no damage or obligations have occurred.
If damage or unpaid fines are found upon return, the Lessor has the right to retain the deposit until full assessment and coverage of costs.
5. VEHICLE PICKUP AND RETURN:
The User must pick up and return the rented vehicle at a predefined location by 10:00 AM unless otherwise agreed on the contract signing date.
If the vehicle is returned late, the Lessor may charge a fee of €100 (or MKD 6,160) from the deposit.
6. USER OBLIGATIONS:
The User agrees to:
- Use the vehicle only for personal and legal purposes.
- Return it in the same condition, with a full tank and clean.
- Pay all tolls, fines, and fees incurred during the rental, in North Macedonia or abroad.
The vehicle must NOT be used for:
- Transporting passengers or goods for pay.
- If false data was provided by the User or listed additional driver.
- Competitions, speed trials, or races.
- While under the influence of alcohol, drugs, sedatives, or any medication.
- If the vehicle is not roadworthy or is overloaded.
- Off-road or unclassified roads.
- In regions or countries restricted in the rental agreement.
- Smoking inside the vehicle is strictly prohibited.
7. LESSOR’S OBLIGATIONS:
The Lessor agrees to:
- Deliver a technically sound and registered vehicle.
- Refund the deposit on time if no cause exists for its retention.
8. DAMAGES, FINES, AND LIABILITY:
The User is liable for all damages to the vehicle, parts, or accessories during the rental period.
Also liable for damage caused by improper use or unauthorized part replacement.
If damage or fines exceed the deposit, the User must pay the difference upon receipt of an additional invoice.
If the vehicle is retained in an authorized service, storage costs are shared 50/50 between the User and the Lessor.
9. RENTAL EXTENSION:
The User must notify the Lessor in writing before the rental period ends to request an extension. The extension is only valid if the vehicle has not been reserved for another customer.
If the vehicle is not returned on time, it will be considered unlawfully retained, and the incident will be reported.
If the return is late and rates have changed, new prices will apply from the originally scheduled return date.
10. FUEL:
Fuel is not included in the rental price. The vehicle is provided with a full tank and must be returned full.
11. DEFECTS:
Repairs or part replacements must be performed only with prior written approval by DPTU GO CAR RENTAL LLC Strumica, and only in authorized service centers.
For foreign repairs, the User must validate receipts at border crossings. Unauthorized repairs are not reimbursed. Lost parts must be paid at market value.
No reimbursement will be made for damages due to improper use or accidents caused by the User.
12. DOCUMENTS AND KEY:
All vehicles include necessary documents for international travel. If documents or the key are lost, the User must pay €500 (or MKD 30,800).
13. VEHICLE INSURANCE:
All vehicles are insured for third-party liability. CASCO insurance is included with a deductible. The User covers damages up to the deductible. Damages to the oil pan or tires are not covered and must be paid by the User.
14. THEFT INSURANCE:
In case of theft of tools or equipment, the User bears full liability. Any theft must be reported to the nearest police station and to the Lessor.
15. ACCIDENTS:
All accidents must be reported immediately to the nearest police station and to the Lessor. A special form found in the vehicle must be filled out and submitted.
The User agrees to cooperate with the Lessor in the investigation. If the User fails to comply, all costs are their responsibility.
16. INSPECTION AND VEHICLE SEIZURE:
All GO CAR RENTAL LLC Strumica employees may inspect the vehicle at any time. If a violation of the contract is found, they are authorized to seize the vehicle.
17. TRAFFIC OFFENSES:
The User is solely responsible for any traffic violations during the rental period and must pay for any resulting damages not covered by insurance.
18. RESERVATION:
The reservation applies to a group of vehicles, without a guarantee for a specific model.
If the customer cancels the reservation for renting the motor vehicle before the scheduled date, the Lessor shall retain the paid amount as compensation for damages.
19. TERMINATION OF CONTRACT:
This contract may be terminated by written consent or if the User fails to fulfill their obligations.
20. DISPUTE RESOLUTION:
Any disputes will first be resolved amicably. If not possible, the Basic Court in Strumica will have jurisdiction.
21. FINAL PROVISIONS:
All amendments will be made by signing an Annex to this Agreement by both parties.
